These Terms and Conditions (“Terms”) govern your use of booksnaggletooth.com (the “Site”) and any inquiry, booking, or purchase of services from SnaggleTooth Productions, LLC (“SnaggleTooth,” “we,” “us,” or “our”). By using the Site, contacting us through it, or purchasing services, you agree to these Terms.

If you do not agree, do not use the Site.

1. Who we are and what this covers

These Terms apply to:

  • Your access to and use of the Site

  • Any forms, scheduling links, or contact submissions on the Site

  • Any estimates, proposals, invoices, and services provided by SnaggleTooth Productions unless a separate written agreement says otherwise

If you sign a separate service agreement, that agreement controls if there is a conflict.

2. Using the Site

You agree not to:

  • Use the Site for unlawful purposes

  • Attempt to access parts of the Site you are not authorized to access

  • Interfere with the Site’s operation or security

  • Copy, scrape, or reuse content in a way that violates these Terms or applicable law

We can update, suspend, or remove parts of the Site at any time.

3. Quotes, proposals, and bookings

  • Any quote or proposal is based on the information you provide and may change if the scope changes.

  • A booking is not confirmed until we explicitly confirm it in writing (email is fine) and, if required, we receive a deposit or payment.

  • Timelines are estimates and depend on factors like weather, access, permits, client approvals, and third-party availability.

4. Client responsibilities

You agree to:

  • Provide accurate information and timely approvals

  • Secure any required permissions, releases, permits, location access, and approvals unless we agree otherwise in writing

  • Ensure safe working conditions at the shoot location

  • Make available any required brand guidelines, reference assets, and points of contact

Delays caused by missing access, approvals, or info may affect schedule and pricing.

5. Payment terms

Unless otherwise stated in writing:

  • Invoices are due upon receipt.

  • We may require a deposit to reserve dates.

  • Late payments may result in paused work, withheld deliverables, or rescheduled shoots.

  • You are responsible for any applicable taxes and third-party fees unless we agree otherwise in writing.

If you dispute an invoice, email us within 7 days of receipt with details of the issue.

6. Cancellations and rescheduling

Unless your proposal or agreement says something different:

  • Rescheduling: We will try to accommodate reschedules. Fees may apply for crew, travel, permitting, rentals, or other non-refundable costs already incurred.

  • Cancellations: If you cancel after we have reserved dates or started work, you are responsible for work completed and any non-refundable costs.

Weather holds and safety decisions (including aviation safety) may require rescheduling.

7. Deliverables, revisions, and approvals

  • Deliverables, formats, and revision rounds are defined in your proposal, invoice, or written scope.

  • Additional revisions or scope changes may be billed.

  • You are responsible for reviewing deliverables. If you do not request changes within a reasonable time, we may treat the work as accepted.

8. Intellectual property and licensing

Our materials

Unless otherwise agreed in writing:

  • We own the creative process, project files, templates, and behind-the-scenes methods used to create the work.

  • After full payment, you receive a license to use the final delivered assets for your business marketing and internal use.

Your materials

You represent that you own or have permission to use anything you provide (logos, music, footage, photos, fonts, scripts, likenesses, brand assets). You grant us permission to use them solely to perform the work.

Portfolio use

Unless you tell us in writing before the project starts, you grant SnaggleTooth permission to display finished work (and reasonable excerpts) for portfolio and marketing purposes. If you require confidentiality, we can agree to that in writing.

9. Third-party tools and platforms

We may use third-party services (hosting, file delivery, scheduling, analytics, payment processors). Your use of those services may be governed by their terms. We are not responsible for third-party platforms we do not control.

10. Disclaimers

The Site and services are provided on an “as is” and “as available” basis. We do not guarantee:

  • That the Site will always be available or error-free

  • That services will produce a specific business result (leads, rankings, revenue, engagement, or similar outcomes)

To the extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the maximum extent permitted by law:

  • SnaggleTooth will not be liable for indirect, incidental, special, consequential, or punitive damages.

  • SnaggleTooth’s total liability for any claim related to the Site or services will not exceed the amount you paid SnaggleTooth for the specific services that gave rise to the claim.

Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless SnaggleTooth from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:

  • Your misuse of the Site

  • Your breach of these Terms

  • Materials you provide that infringe someone else’s rights

  • Your failure to obtain required permissions, permits, or releases

13. Governing law and venue

These Terms are governed by the laws of the state where SnaggleTooth Productions is primarily operating, without regard to conflict-of-law rules. Any disputes will be brought in the appropriate courts in that jurisdiction unless we agree otherwise in writing.

14. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date will reflect the most recent version. Your continued use of the Site after changes means you accept the updated Terms.
